Definitions
Member/ Subscriber – The visitor who signs up to the services of the site
Guest – The visitor who enters on and/or visits the myvrsin.com website without registering to the services of the site.
Performer – An adult person older than age 18 or 21 in some region, which provides video material, chats or interacts with visitors of the site.
Credit Balance – At myVRsin.com, Members have the opportunity of obtaining Credits to pay for premium services, by purchasing tokens. Payments are securely processed by our payment processors, and the purchased Credits consequently appear on Member’s account as a balance pursuant to the prices stated at myVRsin.com website.
Virtual reality googles – Equipment necessary to view some of the content available at myVRsin.com. These googles may be, but not limited to, Samsung Gear VR googles, Google Cardboard googles or any other equipment that allow its user to review 360° virtual reality videos.
Content – Represents video material available for download, online view, live streaming or available to the visitors on any other manner that is recorder in 360° view and can and should be viewed with Virtual reality googles.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Article 1: Service
1.1. myVRsin.com is an online adult interactive website that provide video content mostly designated to view on Virtual reality googles with 360° degrees view area. 2.2 myVRsin.com may review and delete any Performer Submissions that, in its sole judgment, violates this Terms and Conditions or may be otherwise offensive or illegal, or violate the rights, harm, or threaten the safety of any Member, Guest or person not associated with myvrsin.com(collectively “Inappropriate Performer Submissions”).
2.3 Member and Guest and any other consumer of the Service hereby accept that Content that is made available at myvrsin.com is complete and shall be considered „as is“ without any obligation that may arise for myVRsin.com to modify the provided content and/or its video format.
2.4 The publication of different content on the website does not mean that myVRsin.com supports the author or takes the responsibility for such content.
2.5 myVRsin.com does not allow any illegal content. Child Pornography, bestiality, rape, torture, snuff, death and/or any other type of obscene and/or illegal material shall not be tolerated by myVRsin.com. myVRsin.com shall not condone child pornography and will cooperate with all governmental agencies that seek those who produce child pornography.
Article 3: Equipment for viewing
3.1 Member and Guest can purchase equipment that is necessary for them to view Content available at myVRsin.com at their own discretion.
3.2 myVRsin.com shall not have any obligation to either provide Member and/or Guest with adequate equipment in order for them to be able to view the content available at myVRsin.com website nor to modify the Content available at myVRsin.com in order to make it compatible to Member´s and/or Guest´s Virtual reality googles.
3.3 myVRsin.com cannot be held liable for any material damage or malfunction to Member´s and/or Guest´s viewing VR equipment which occurred during viewing the Content or the Service. Member and/or Guest hereby waives any right any damages claim in that respect.
Article 4: Prices
4.1 Before Member or Guest select the services intended, it is important that they consult the content, price list and means of payment (credit and debit cards, online checks, etc.) established for such services for their country. This information is available on the website. Prices and services are determined and can be amended by sole discretion of myVRsin.com.
4.2 Neither myVRsin.com nor any party involved in creating, producing, or delivering the service or content is liable for any direct, incidental, consequential, indirect or punitive damages arising from the access to, use of, or interpretation of, the services, products or information provided by or through myvrsin.com, without prejudice to the terms established below in the present Terms and Conditions.
Article 5: Customer Support
5.1 myVRsin.com shall provide Member and/or Guest with customer support service in the scope that myVRsin.com deem as necessary.
5.2 myVRsin.com shall publish contact information for Member and/or Guest to contact customer support at the website.
5.3 Upon an explicit approval from Member or Guest (this approval may be granted by email or online chat), the myVRsin.com Customer Support can initiate a remotely controlled session to access the customer’s computer or other system dedicated to view of virtual reality content and is remotely accessible in order to fix technical problems or to gain system information to find the origins of an error.
5.4 By expressing their approval to a ‘remote control session’, Member or Guest undertakes and agrees to waive any legal action he may have against myVRsin.com as well as its staff and/or other company or its staff that provide customer support services to myvvrsin.com, in relation to the remotely controlled session.
Article 6: Accounts
6.1 When Member creates an account with myVRsin.com, he must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of his account on our Service.
6.2 Members are responsible for safeguarding the password that they use to access the Service and for any activities or actions under their password, whether their password is with our Service or a third-party service.
6.3 Members agree not to disclose their password to any third party. Members must notify myVRsin.com immediately upon becoming aware of any breach of security or unauthorized use of their account.
6.4 In order to create account at myvrsin.com it is mandatory to be at least 18 years old or 21 in some regions, in compliance with the local regulations applicable to Member. It is prohibited for minors to register as Members at myVRsin.com.
6.5 By registering on myvrsin.com and by accepting these Terms and Conditions, Member agree to indemnify, pay the costs of defense and hold harmless myVRsin.com, its officers, directors, affiliates, attorneys, shareholders, managers, members, agents and employees from any and all claims, losses, liabilities or expenses (including reasonable attorneys’ fees) brought by third parties arising out of or related to their conduct, statements or actions, as well as breach of any term, condition or promise contained herein and unlawful conduct in the framework of this agreement.
6.6 These Terms and Conditions shall be effective as from the date when Guest enters myVRsin.com and/or Member registers on myvrsin.com and accepts this agreement and shall remain in force until duly terminated by either party in full compliance with the terms and conditions expressly set forth in this Terms and Conditions.
6.7 myVRsin.com can terminate any Member account at any point of time pursuant to their sole discretion.
Article 7: Payment
7.1 Member may purchase credit packages to spend in order to purchase services at myVRsin.com; price list and means of payment shall be available on the website.
7.2 For banking expenses information, each Member should consult directly his/her bank.
7.3 myVRsin.com will not take responsibility for any difficulty in respect of payment occurring outside myVRsin.com.
7.4 Any complaint in respect of payment must be placed, within 24 hours starting from the occurrence, at myvrsin.com – Customer Support. Given the complexity and particularities of the procedure to determine the righteousness of the complaints placed after the referred 24 hour period, these shall only be acknowledged in cases of force majeure.
7.5 Notwithstanding the above, myVRsin.com will not be liable for any defamatory, offensive or illegal conduct of any Guest/Member, or for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of or use of records, whether under contract or tort theory, or under any other cause of action, for any amount over and above the amount paid by the Member/Guest to myVRsin.com.
7.6 Under no circumstances, including, but not limited to, negligence, shall myVRsin.com or any of its related, affiliated companies be liable for any direct, indirect, incidental, special, consequential or punitive damages that result from the use of, or the inability to use the Service, without prejudice of the established in the present clause.
7.7 Member accepts that in case of any fraudulent transaction myVRsin.com has a right to use all available information at its disposal during any kind of legal procedure. Including, without the claim of completeness, browser history, IP and email addresses and any other traceable activity.
Article 8: Member´s statements
8.1 Member hereby declare:
8.1.1 I am fully aware that myVRsin.com provide Adult content to its Guests/Members.
8.1.2 I am fully aware that viewing adult content is only allowed for viewers of at least 18 years old or 21 in some regions and I expressly declare that, on the present date, I have reached the necessary age to view adult content in accordance to my local regulations.
8.1.3 Reading and/or viewing content on the myVRsin.com website does not in any way infringe the norms or law that are applicable to me.
8.1.4 I am fully aware of and agree that myVRsin.com can grant full cooperation to legal authorities investigating fraudulent transactions and other matters falling under legal jurisdiction as well as responds to subpoenas and court orders.
8.1.5 I also acknowledge that myvrsin.com or any of its related, affiliated companies cannot be held responsible for any damages or losses originating from any contact I made with Performer.
8.1.6 I agree and acknowledge that intellectual property rights (including but not limited to right to use, adapt, translate, etc.) to any content (e.g. chat, messages, pictures, videos, etc.) created, published or otherwise made public to me on myvrsin.com belong to myvrsin.com.
8.1.7 I hereby expressly waive any rights and declare to withdraw any claim that any use by myVRsin.com violates any of my rights, including but not limited to moral rights, privacy rights, rights to publicity, proprietary or other rights, and/or rights to credit for the material or ideas set for therein.
8.1.8 I will never expose minors to the content of the website and will take on full precautions to avoid any type of exhibition or access of the minors to the website, namely, for example, by not including the website in their list of favorite sites to visit. I will be solely responsible in case any minor would access myVRsin.com through my account or by using my credit card details.
Article 9: Links To Other Web Sites
9.1 myVRsin.com may contain links to third-party web sites or services that are not owned or controlled by myVRsin.com.
9.2 myVRsin.com has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that myVRsin.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
9.3 myVRsin.com strongly advises Members and Guests to read the terms and conditions and privacy policies of any third-party web sites or services that they visit.
Article 10: Termination
10.1 myVRsin.com may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if Member breach the Terms.
10.2 All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
10.3 myVRsin.com may terminate or suspend Member´s account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if Member breach the Terms.
10.4 Upon termination, Member´s right to use the Service will immediately cease. If Member wish to terminate his account, he may simply discontinue using the Service.
Article 11: Governing Law
11.1 These Terms shall be governed and construed in accordance with the laws of Serbia, without regard to its conflict of law provisions. Competent court shall be Commercial Court in Mahe.
11.2 Failure of myVRsin.com to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between myVRsin.com and its Members and/or Guestsregarding our Service, and supersede and replace any prior agreements the parties might have between them regarding the Service.
Article 12: Changes
12.1 myVRsin.com reserve the right, at its sole discretion, to modify or replace these Terms at any time. By continuing to access or use myVRsin.com Service after those revisions become effective, Member and/or Guest agree to be bound by the revised terms.
